I am an advocate. My friend wants me to defend his known ones, who resides about one thousand km away from my city, in a court case. Plaintiff belongs to my city.
My friend says that he will get me signed vakalatnama.
Since i will not have any opportunity to meet the defendant, what precaution shall i observe to ensure that vakalatnama is signed by the real defandant (proprietorship/partnership concern). Actually in my city cases have happened where advocates were duped in good faith.
In case i file the vakalatnama and as my friend says that a compromise is going to be effected, what shall i do to save myself from any legal problem related to authenticity of signatory of vakalatnama, as statement related to compromises will have to be made by me in the absence of party.

I suggest that you go with your friend and assert real fact of vakaltnama & get it signed in your presence and then file it in court. After this you will not have to face any problem.

Why go. Call the client do not lower our profession. call once the client to sign the vakalatanama. If he cant come and are in good relations with your known ones then as stated by our expert . you go to assert reality.

In the back ground of facts stated , you do need some extra caution ,it would always be better as advised by S.GANESAN.,to get it signed in your presence,but in case the same is not possible and some exposure in friendship is apprehended then suggest him to sign the vakalatnama at his place but signature attested by a notary public and the same be sent to you accompanied by a letter pasted with photo graph your friend clearly mentioning the case no court and title of parties in which you are being directed by him to appear and defend and compromise on his behalf and that letter should also be verified by notary and should be sent to you as hard copy by speed post and a soft copy by attachment via email on your email address.

You ask for xerox copy of PAN Card and Voter ID card. Compare the signature with signature appearing in PAN Card.

I also add one more thing that attested signature by bank manger is also safe play in absent of PAN Card.
