Wages for maids

(Querist) 22 January 2014 This query is : Resolved
We are owners in a residential complex of 100 flats. Have 2 (of 5) housekeeping maids working last 12 years on a temporary basis.
New management has terminated them. Are they eligible for any compensation, as they have been treated only as TEMPORARY workers ?

Are they eligible for any compensation, as they have been treated only as TEMPORARY workers ?
NO.
Rajendra K Goyal (Expert) 22 January 2014
As per Rule No.

Rule does not prevent voluntarily giving of compensation by society.
Raj Kumar Makkad (Expert) 22 January 2014
Temporary workman has no lien against their post but society is free to compensate them.

Better to approach the issue with some humanity if they are not under any faults.

Some of us (residents) feel that these 2 poor laborers were cheated because, they have worked for 12 years continuously and their names are there on the weekly wages sheet for 12 years. Is it not depriving them of their rights, to keep them work without Bonus, PF etc . Can they approach labour court ( through one of you) and what are the chances to get them compensation..Regards
Sudhir Kumar, Advocate (Expert) 23 January 2014
they can approach labour court.

why they were temporary for 12 years?

what were your registered terms and conditions as per Standing Orders Act?
