Want to know about partition suit

(Querist) 06 November 2014 This query is : Resolved
when grand father did not willed any property and it was divided unequally by tahasildar can partition suit be done?
Anirudh (Expert) 06 November 2014
The tehasildar has no business whatsoever to partition the property.

Each legal heir of your grand father is entitled to equal share in the property.

In case, you feel that, the property has not been equally divided, then in that case, please meet with a local lawyer who is well versed in property law, discuss things and then take forward the matter. It will definitely involve approaching the Court and costs.
Advocate M.Bhadra (Expert) 06 November 2014
Tahshildar has no right to make a partition of the property, if your grandfather died intestate then the property may equally partition among legal heirs amicably by a registered deed of partition, failing which may be filed a partition suit in civil court.
