Dear Experts,
If after show cause notice to delinquent employee the employee ask for forgiveness in his written reply.
Can management issue him warning letter based on the reply by the employee or to issue the Warning Letter " Domestic Enquiry is mandatory ?"

Invariably in such a condition only a warning letter is issued which is sufficient.

By asking for forgiveness, the delinquent employee has accepted his guilt, so no further enquiry is required.

Warning letter is just to warn the employee, if the employee accepts the mistake, the company will not proceed further.
But, this warning letter is for small offenses or mistakes only.

After admission of guilt by delinquent employee, ball remains in the court of management and it may award punishment as it deem fit within the facts of case/matter.

If the mistake is smaller, a 'caution' is enough. 'Warning' itself is a punishment and hence, would affect his future.
