(Querist) 26 December 2010 This query is : Resolved
My Learned Friends,

1. What is the legal procedure to change the official name of a person like I have a name
"Kumar Krishan Agarwal" and Now at this age I want from today to change my name "Amit Agarwal" used every where in every part of life and be valid to my previous Education and all other things in respect of property inheritance and my identity (voter ID card, passport, driving licensee, bank account, insurance etc) all will be treated as Amit Agarwal from now onwards?

2. What the legal steps I have to take so that the new name will be coincide with my previous name and both names are treated me as a one single person ?

First of all you have to affirm an affidavit before the Magistrate in respect of change of name and also you will be known and recognised by your new name henceforth and also make a news paper publication in local news paper in respect of the affidavit make before the magistrate.

In case you wish to change your name you have to follow a very simple procedure.

--------------------------------------------------------------------------------

1.Go to the State Government Press in the Capital City of your state.

2.Ask them for the form for change of name and obtain it.

3.Fill up the form and submit it(preferably then and there).

4.Pay the requisite Fees in cash.

5.The Press would publish the details of the change of your name (or father's name, or surname as be your case) and post you two copies of the Government Gazette or ask you to collect the same. The press would also let you know when they would publish the same.

6.Thereafter wherever you wish to submit your change of Name / Father's Name / Surname Proof, you can submit true copies of the relevant pages of the Gazette.

Names in the certificates will not be changed by any means.

only you can keep a copy of the name change gazette along with the certificates and claim your new name.

for treating both names as one for insurance policies etc, give a copy of the name change notification and add "alias" new name to it.

under what provisions of law such a procedure is prescribed. Can any one guide?
Kirti Kar Tripathi (Expert) 26 December 2010
I agree with Mahendra Kumar. No procedure is prescribed for change of name. The name can be changed till a person fill the examination forms of High School or 10th class of any Board Examination. There after no possibility at all to change names in certificate.
PJANARDHANA REDDY (Expert) 26 December 2010
YOU CANNOT REMOVE OLD NAME FROM ANY RECORD OF PREVIOUS EVEN THE NEW NAME GAZEETTED . THE NEW NAME CAN BE ACCEPTED AND FUTURE YOU CAN PROCEED WITH NEW NAME. EVERY TIME YOU SHOULD JUSTIFY THE NAME CHANGE WITH GAZZETE COPY .
N.K.Assumi (Expert) 26 December 2010
As pointed out by Sir Reddy, your previous name can not be changed in those previous records, but from now on to robe yourself with a new name just published it in the local paper changing your name from the old one with the new name and execute an affidavit and produced the same whenever required, nothing great about it.

It seems Mr.member deleted is vishal. I am missing him in LCI.
R.Ramachandran (Expert) 26 December 2010
Yes, it is Mr. A.V.Vishal's account.

But I understand that Mr. Vishal himself has edited his profile in this manner.

While we do not know what prompted him to do so, it is my earnest request / appeal to him to restore his Membership name as earlier. It need hardly be told that his contributions are too good, valuable and insightful. One hopes that Mr. Vishal will heed to our request very soon.
Advocate. Arunagiri (Expert) 26 December 2010
I fully accept and repeat the request of Mr.Ramachandran.
