Send legal notice and file case.

Casual query may not solve the problem, it is better, discuss with some senior consultant in the field for practical guidance and with the concerned department to clarify your doubts further.

Study the Bajaj Vs TVS case in detail, right from beginning.

You will get to learn a lot from it.

Avoid posting academic queries on this platform.
T. Kalaiselvan, Advocate (Expert) 27 May 2016
You cannot develop your practice on the basis of brief opinions you get from platforms like this. You have to put your best efforts and hard work to learn more and more about the subject which you have chosen to practice in future.
Since it will be easy for you to have an access to settled laws by visiting the libraries and consulting with seniors in this field, you may have to first ascertain problem, choose the answers for your problem and if not not able to find any solution then you can refer your problem for a solution with a mention about the efforts you have to take to solve the issue and not able to get any solution to this.
