What to do if police is taking side. IS RTI possible

Querist : Anonymous (Querist) 27 March 2011 This query is : Resolved
hi

What can be done if police is taking side and ignoring proof provided by husband.

Whom shd we approach, despite providing proof police is harrasing us.

Can RTI be file to get details of investigation done in 498a case and question police why they are ignoring the evidence.
Devajyoti Barman (Expert) 27 March 2011
Male a petition with the Magistrate in that respect. The Magistrate can make necessary directions towards the effective investigation of a case.
Arvind Singh Chauhan (Expert) 27 March 2011
First time I disagree with Honourable Barman Sir. Magistrate can not interfere or can't give direction in investigation.

You can approach to higher police officials or may request before HC to change the investigating agency.

Barman Sir! please correct me if I am wrong.
Advocate. Arunagiri (Expert) 27 March 2011
The police is bound to give information under RTI act.
Devajyoti Barman (Expert) 27 March 2011
No Arvind ,you are wrong.
The Supreme Court has made it quite clear the Magistrate till the charge sheet is filed is equipped enough to keep watch on the investigation and may direct the investigating officer to give even a day to day status report to the court.

ok

I intent to file an RTi, to know what investigation is done and why he choose to ignore certain witnesss while picking others.
any format would help.

police is not bound to give the information about the investigation Mr arunagiri I think is wrong, because it's barred by crpc. court will supply the copy of charge-sheet after completion of investigation u/s 207 crpc. there is no provision in crpc to give detail of investigations. What you can do i.e after submission of the charge-sheet if you find that the investigation was not properly done ,you can challenge the charge-sheet or demand further investigation. This is the proper way.
R.Ramachandran (Expert) 28 March 2011
Yes, police is not bound to give information about the investigation to any one under RTI.
Arvind Singh Chauhan (Expert) 28 March 2011
Thanks Barman Sir to correct me.

in this case daily diary report can be called in the court and it will come into the knowledge of the court what is going on.
Debasish Hota (Expert) 28 March 2011
The police is not bound to reveal the proceeding of investigation under the RTI Act . The Magistrate can not interfere with the investigation . If you are not setisfied with the investigation you can proceed the High Court to change the investigating agency . Why are you not proceeding against the concerned Investigating Officer under the Police Act and Indian Penal Code.
