Whether any legal remedy is available for appointment?

Sir,
I have been selected by DSSB examination in year 2008 and I had received appointment letter in August 2009 for the post of Audiometric Asst at Govt Hospital. During at time my CAT case aginst AIIMS for regularisation of service (as I had been working on adhoc basis )was pending and I had made request for extending the period of Joining till disposal of the matter.. I lost my case for regularisation in June 2011 and I made by representation to the Govt Hospital for appointment of Audiometric Asst Post which was refused that my request cannot be accede to after a gap of 2 years as per prevailing Recruitment Rules

Sir, Thanks for the message. In case if no person had joined there and the posts are lying vacant then whether any suit/Application is mainatainble before any Court i.e CAT??

No such application will be considered.
You did not join the post....and in the mean time the post has lapsed.
Now,if the concerned department needs an employee for the said post then there will be fresh advertisement. Otherwise, everyone will be putting the govt. on tenterhooks.
you will have to follow the rules.

Dear Anonymous,
For your knowledge, organisations work on set standards and rules and do not work at the sweet will of the employees, that too if still a candidate, who has not yet become part of the organisation.
Even otherwise also, any part of select list that remains inoperative for one and half years becomes invalid.
You may have to get selected afresh, if you desire to work on the post.
