Whether final decree can be done without concern parties presences,

sir,this is regarding civil suit property,which has been allotted to first party father by court in civil suit,thereafter they became L.R. in same court,then first party did registerate assignement deed to me same property and i paid their consideration amount,and i filed for recognizing of registerate assignement in honble high court and prayed for final decree,the honble court recognised the above assignment deed and record first party statment in presence in court,but final decree execution remain,so now when i seek for final decree in this concern court,the honble court notice to first party and the said notice return unanswered ,and now i got to know that first party seeking more money and harrassing me by not answering the court notice for passing final decree in my favour, SIR my question is since notice returned unanswered whether the honble court can pass final decree in favour because its already record the statement of first party in court in presence while reconizing registrate assignment in first party presences, please advise sir thanx.

what are the remarks on the envelope. whether it is returned with remarks intimation given or refused or closed etc
.if notice has been duly served on the party court can pass final decree in your favour
