Whether general body resolution required to appoint a lawyer

Sir, There are many disputes in our coop housing society.We want to hire a lawyer and file legal cases. But we do not have support of 70 percent of members . Even 3 out of 7 committee members are not supporting us. Can we as a secretary chairman and ex-chairman can hire a lawyer.mEMBErs are continuously filing complaints against us to police and registrar. Kindly guide

Pass a Resolution in EC Meeting and appoint an advocate to defend the cases and also to file cases- as per the Society Bey laws !

Does your by- laws require the permission of 70% members to appoint a lawyer? If so and if you have not the required support then you can always appoint a lawyer on your own or on individual capacity.

we do not have any society byelaws .We do not know whether we can appoint lawyer on individual capacity to defend ourselves and to file petitions using society fund without the approval of the general body

Yes. U can make a complaint to the Registrar of Co-operative.
