Whether lease agreedment should be registered?

(Querist) 27 December 2011 This query is : Resolved 
I would like to know details, please help me
1.How long lease agreement period valid
2.Whether it has to be registered-compalsory?
3.If not registered, whether it is valid?
4.If registered,how much amount it has to be registered?
One of my friend informed that, if lease amt is 2 lac, it has to b e registered compulsory. Please help me

1. if you house site for every 3 years you re agreement if you govt land 99 years valid.
2. more than 50k must register if lease
3. valid but the court that time will fine more than 20% for non register document

LEASE”, as defined in Section 105 of the Transfer of Property Act, as a right to enjoy property for a certain period in consideration of the price paid.

An instrument creating a lease of immovable property for a term of one year and above was required compulsorily to be registered by virtue of provisions of Section 17(d) of the Indian Registration Act.

It all depends on the kinds of relief you are asking from the court with regards to unregistered lease deed. If it is for ejectment of your tenant, though unregistered lease deed is inadmissible as pointed out by the expert, you can tender oral evidence to prove the bare fact of tenancy.

1.for the period agreed by parties and term incorporated in lease.
2.If the term of the lease is more than year it's registration is a must.
3.YES!when registered it is valid.
4.The rate of rent into period for valuation
togather with premium, if any, on which stamp duty would be payble at the rate provided in law of state.

Please find my answers
1. Lease shall be for any period of time which is more than one year.
2. Lease agreement shall be registered after paying the requisite stamp duties.
3. Unregistered lease deeds/agreements are not valid in the eyes of law.
4. Your friend is wrong in saying that the lease deeds for more than 2 lacs shall be registered. Istead, any lease deed for a period of 1 year or more shall be compulsarily registered. The stamp duty depends on the rent, deposit, lease period etc.
