Who are legal heirs

One person who is married and has a wife and child. He expires. His wife and child are his legal heirs. But are his parents also his legal heirs?

This is in respect of a Flat he owns at Mumbai and in respect of membership of the Housing Society.

Not parents, his widow, child and mother are legal heirs. Father is no class-I heir.

Legal Heir: Refer to Personal Law that Applies to the deceased e.g Hindu Succession Laws..................



Flat at Mumbai/Membership of Housing Society;

Refer to Section 30 of Maharashtra Co-operative Societies Act, 1960..........

While the society shall prefer nomination as in its record the rights of legal heir can not be take away..............

Only children, mother and wife are the legal heir in this case.
