Can I and my husband make a joint will? In effect we want our property to go to each other after the demise of one.
After demise of both, we want to lay out the procedure for distribution of our assets to our two daughters.
We have one flat in my husband's name and one shop in my name. Apart from this we have one flat in joint names of myself, my husband, and the elder daughter.

There is no law for executing a joint will in India. You and your husband can separately execute a will which can be devised to each other as wished by you after death of another in respect of both of your properties in respective individual names. So far as the flat in joint name with your daughter is concerned, both of you can make provision of transfer separately only in respect of both of your individual shares in the said flat.

Joint Wills: Two or more persons can make a joint Will. If the joint Will is joint and is intended to take effect after the death of both, it will not be admitted to probate during the life time of either and are revocable at any time by either during the joint lives or after the death of the survivor.

You and your husband can make two seperate wills,not one joint will.
