A has filed a case before the court, and it is now at the stage of EBC. now due to compramise A wants to withdraw the case. Whether A can withdraw this case by giving a withdrawal pursis? if not then what is the procedure to withdraw this case. please answer urgently.

Since the case is non-compoundable one , mere withdrawal petition is not sufficient to get the case withdrawn. Rather after submission of charge sheet , the de facto complainant will have to be present and state her mistake to file the case under mis understanding or out of related cause. The witnesses will take the same line.

No the case can't be withdrawn as the state has taken action against the accused. it is better to go for compromise and later file 482 for quash of proceedings.

If it is a complaint case then you can withdrawal but if it is state case then approach High cout u/s 482 for quash.
