Hi, my maternal grandfather purchesd property in agra 1970. My grandfather expires in 1984. After death of my grandfather no partiton happen till date. I want to know about my mother have rights in my grandfather property in agra. After hindu amendment act 2005, my mother no rights in property. Explain amendment act 2005. I confused.

If your maternal grandfather had died intestate than all his legal heirs are entitled to get equal share in his self acquired property.

What is the nature of property; Is it Agricultural?

daughter has right in the property of her father. She can file partition case.

Sir, in same property, I get to know my one mausi my mama ji not mentioned my mother name in tehsil agra, for legal heirs of my grandfather. By mistake she told me. My grandfather legal heirs 3 son and 4 daughter. 1 mama ji died recently january, he is unmarried. 1 mama is missing last 2 year. And finally last mama elder of all legal heirs want to take all property, and property is his possession. My 1 mausi expires, she is 2 daughter and 1 son. Other 2 mausi ready to give her share to my elder mama. My question is that, my mama ji take all property his name tehsil agra with the help of two sister. Is it possible or not. Now my mama ji not create deed because my missing mama ji police not declared death because He is missing for two year. What can i do before my mama ji create deed. I also sent objection through rti application to agra tehsil. That is sufficient.

Sir, the problem is that my mother dont have any document to prove she is a daughter of my grandfather. My mother marriage at the age of 14 year. After marriage 1975 he is residing in delhi with my father. And all voter id, aadhar card, husband name mentioned. My mother last year make pan card father name mentioned by mistake (my Grandfather name mentioned in pan card). This pan card form father name fill in the blank option thats why i fill grandfather name. That time i dont know pan card husband name also mentioned when we fill for. Please help me what can i do. Because I dont filed court case Now. I only want that property my grandfather name in tehsil not my mama ji. I only want stop This property my mama ji name. Because Now father is not well he is paralise attack.
