Dear All
Please guide the practical procedure and the escape root if any of my question regarding WC policy in GUJRAT
My client is having WC Policy which covered the employee of sub contractors also. A casual worker age 38 years who was drawing wages which comes more than Rs 4,000/- per month died during the work due to the hit of pipe by a vehicle. Client filed the documents and reports to Labour Commissioner. Now the question is
1. Should Company deposit the compensation amount before labour officer as per act with in one month or wait for any communication /
2. Should us wait for insurance company and ask them to pay the money?
3. Any other procedure or escape root which we can do?

Have you/authorized personnel notified the commissioner for the death?
You have cited Workmen Compensation Act hence Refer to : Workmen Compensation Act: Sec 4A, 10A, 10B, 12, 18A, 31……
Likewise you may on your own refer to EMPLOYEE'S COMPENSATION ACT, and its provisions………………
There is no escape route.

Thanks doab.yes notified, but want to know can the compensation should be paid by insurance company immediately on receipt of information on behalf of us or after the award of commissioner. What is the normal practice..

The question arises, what is the link between the compensation under the WCA and the insurance?
Also, whether insurance premium is paid by the company or the worker and whether the claim is to be preferred to the Insurance company by the workman or the employer company can encash diretly from the insurance company?
