WORKMEN UNDER I.D ACT

Dear Sir,

Can I have our opinion of experts regarding salary ceiling of Rs 1600/- in I.D Act for workman. Please tell me whether the ceiling is lifted or it has been raised. In one of my queries related to workman under Payment of Wages Act, 1936, I got the answer that the the salary ceiling has been revised to Rs 6500/-.

Is there any meaning in continuing the ceiling of Rs 1600, as it appears outdated to me.

I invite the opinion of our esteemed members to this question.

Also my previous question regarding strikes and lock out in private enterprises have not been answered. Please advise.

There is no ceiling on wages to be a workman under the ID Act as per section 2(s). It is the nature of job performed by the employee which determines his status of that being workman or not. The ceiling of Rs. 1600 for a supervisor to be incuded in the definition of workman.

You can under with a very simple example : A pilot of Indiar Airlines who is getting a monthly salary of repees 1 lakh per month is a workman or not as per the defination of I.D.Act? Simply the answer is that is workman becase he is not having any supervsior work. If employee is doing supervisiory work but drawing a salry of rupees less than Rs.1600/ per month is comming under the defination of workman.
