Writ petition.

(Querist) 10 April 2012 This query is : Resolved
I have been complaining to RBI regarding wrongdoings of some banks but the RBI is not responding properly.
Can I request High Court or Supreme Court thru Writ Petition to order the RBI to take action against the banks as per respective laws and regulations? How?
R.K Nanda (Expert) 10 April 2012
File a writ of MANDAMUS in Supreme court of
India so that SC issue directions to RBI to
take action against banks.
Raj Kumar Makkad (Expert) 10 April 2012
Definitely you can do so but it shall be better to serve a legal notice to RBI in this regard as last resort.

you just bring this issue before the knowledge of banking ombudsman.. before that issue a legal notice to the concern bank..

instead of approaching the supreme court or High court, first file RTI Application to know the status of your complaints . RBI has to respond to your application within 30 days. depending upon the nature of the reply , you can decide future course of action.
Atul Kumar Khare (Querist) 12 April 2012
Already aggrieved by the Banking Ombudsman, I wrote to the Governor-RBI but he replied that he cannot do anything. Thus no requirement of RTI.
What is 'Writ of MANDAMUS'?
Dr J C Vashista (Expert) 15 April 2012
Rightly advised by expert, file a writ petition before High Court and not SC for issue of mandamus (Direction)to RBI,
THERE IS NO NEED FOR NOTICE.
