(Querist) 12 December 2009 This query is : Resolved
An official who had served in para-military force in Delhi and permanent resident of Kolkata(West-Bengal) wrongly removed from service. The official now wants to file a Writ in Kolkata High Court. Pl. clarify the following:-

1. Whether any time limit is prescribed for filing Writ in the High Court?

2. Can the official concerned file the Writ in the State of West-Bengal i.e.his permanent residential address?

3. What are the main condition for filing such service matter Writ?
Devajyoti Barman (Expert) 12 December 2009
1. For filing writ petition there is no time limit but the time of invoking the writ jurisdiction should be reasonable from the date of cause of action.
2.The official can file the writ petition in the High Court in Calcutta if his employer has got any of its office here.
3.Without knowing the fact of the case it is difficult to state the condition but any material irregularity committed by the department or violation of the legal right of the petitioner will be sufficient condition for filing writ.

Nothing to add, as Barman has stated correctly.

I do agree with barman
