Wrong date in the agreement

(Querist) 11 August 2015 This query is : Resolved
Dear sir,

IN the Memorandam of Agreement the date mentioned in the begining of the agreement differs from the date of execution. My questions are:
1. Whether the document is legal or void
2. How to rectify without getting the authentication from the executor.

Please Help.

With regards

There cannot be two different dates for agreement. The date mentioned in the beginning should be the date of execution as it runs like....This agreement is made on this...day of...
Whether it is registered agreement or unregistered? What is the reason? Is it because of oversight? If so and if it is unregistered document, the wrong date can be changed under the signatures of the parties to the agreement.

Rectification not possible till all parties agree to it.

Why you want that the rectification be carried out without authentication by the executor?
M V Gupta (Expert) 12 August 2015
The date indicated in the beginning of the deed should be the date on which the last party has signed the document.Even if the date is different it will not affect validity of the document as always the Court will take the date on which the last party has signed the deed as the date of the document.

I agree with the expert advise of Mr. M V Gupta, the date of MOU and execution of MOU shall not affect the validity of document, it is valid.
T. Kalaiselvan, Advocate (Expert) 18 August 2015
The date of agreement and date of execution may differ but there is no legal infirmity in it.
