498a no automatic arrest reults??

Hi all,


We all know that SC has ruled "no automatic arrest in 498a" sometime back. Do we have any statistics that shows false cases are reduced or furhter increased.

1. Make a fertile effort first instead of rhetoric. Reason being no data collected via RTI Application to all State’s DGP's HQ and/or no RTI Application to all State's HC's to give 'information' from all Trial Courts under her on Guidelines of MHA issued in August to All State’s DGP's and HC's based on just 2 months old Apex Court Judgment and just 1 month old MHA Circular to all State's and you want to know ‘statistics’?

Dear Friend,

It is true that majority of 498a cases are false but...

1.When a case is filed, how can you say whether it is false or true.

2.SC has said that there should be no automatic arrests.This means that unlike it used to happen before,police will not blindly put the entire family behind bars.They will first investigate and then mostly the husband is made the accused.SC statement does not mean that filing of false cases will reduce.

Not a very good formatted Word Document file, but victim(s) can read the reasoning well in attached file which is in MS Word format of the Order of a Trial Court in Delhi District Court thus resulting into ONE LESS ARREST in a S. 498a IPC Complaint case based on subject matter of your query.
