Did you file a case of custody of minor in the Court where child is presently residing (with mother),  if your wife did not agree to give the child to you ?

I'll provide guidance on child custody under the Hindu Marriage Act, considering your situation. Factors Influencing Child Custody:

1. *Welfare of the Child*: The court's primary consideration is the child's welfare and best interests.

2. *Financial Stability*: The financial stability of both parents is a crucial factor.

3. *Parental Abilities*: The court assesses the parents' ability to provide a stable and nurturing environment.

4. *Child's Age and Education*: The child's age, education, and needs are also considered. Custody Options:

1. *Joint Custody*: Both parents share custody and decision-making responsibilities.

2. *Sole Custody*: One parent has primary custody, while the other may have visitation rights.

3. *Shared Parenting*: Parents share physical and emotional responsibilities. Your Situation:

1. *Your Wife's Qualifications and Current Status*: Although your wife is educated, her current unemployment might be considered by the court.

 2. *Your Son's Age and Education*: As your son is 7 years old and studying in a public school, the court may prioritize stability and continuity in his education and upbringing.

Possible Outcomes:

 1. *Joint Custody*: The court may grant joint custody, considering both parents' involvement in the child's upbringing.

2. *Sole Custody to You*: Given your wife's current unemployment, the court might grant sole custody to you, ensuring financial stability for the child.

 3. *Shared Parenting*: The court may order shared parenting, allowing both parents to participate in decision-making and childcare responsibilities.
