Dear experts
Case status :
a) Ist time 498a filed in which cleanchit was given in FR submitted by police, which is under protest as challanged by her.
b) meanwhile she filed 498a second time, in which CS filed .(Challanged in HC u/s 482 last week as suggested by many forum members as well as by my counsel)
c) DV case pending for maintenance : on evidence stage (since 1.5 years)
Now:
I have one daughter 5 years old. i want her custody and take back. Pl suggest me :
1) Weather to file GWA or any other remedy ?
2) What grounds one should take for such applications ?
3) Weather devorce should be filed along with this, based on cruelty of false cases of 498a or it would be negative for taking custody of my daughter ?
