Delhi HC directs constitution of judicial tribunal in FTDRA

Hi All !!!

 

The Hon'ble Delhi High Court vide its Order & judgment dated 29.4.2010 in WP (C) No. 2577/2010 has passed a landmark judgment & order which would come a long way. We represented the Petitioner in a matter relating to foreign trade development matter involving an appeal before appellate authority who is incidentally a departmental person. The verasity and consitutionality of Section 13 and 15 of Foreign Trade (Development & Regulation) Act was under consideration.

Having heard us at length for good hours, the Hon'ble Division Bench comprising HMJ SANJAY KISHAN KAUL and HMJ VALMIKI J.MEHTA, has opined as that (operating part only)................. "We thus, feel it would be appropriate to provide for an independent quasi- judicial tribunal on the lines CESTAT as observed in the Siemens Engineering and Manufacturing Co. of India Ltd?s case (supra). Petition is accordingly stands disposed off with the aforesaid observation to be examined by the concerned authority. Copy of this order be sent to the Secretary (Commerce) and Secretary (Law)."
