Drinking in common open areas of society

Dear Experts,

As per IPC the definition of "public" means any class of people or community. In accordance with this is drinking  common areas, unenclosed sheds etc. legal with a residential society/ apartments? There is no specific mention in the by-laws for this either in ours or various other major communities , so I wanted to check with experts.

It may not be illegal. But it's possible that it may be against the rules and regulations of that apartment or society.

You may visit the bylaws of your association and ensure that you do not violate the prescribed bylaws  or create nuisance to fellow members of the assocaition by indulging in such acts.

Drinking in public creates nuisance and is therefore punishable by the law. Public drinking may not be a common site in India; however, car-o-bar has become a simpler way to drink for youngsters.

Consuming alcohol at public places will attract a fine of Rs 5,000 and if the offender creates nuisance than the fine shall be up to Rs 10,000 with a jail term of three months.

Drinking alcohal in public is an offence for that you are required to approach managing committee and police.
