Final order of district forum

The state consumer commission can set aside any district forum order on merits. But there is significant view on exparte orders different from exparte final orders. For deliberate absence of a party ignoring the calls of district forum, some kind of penel action set by the government is by way of making the law ignoring party to approach only the national commission for revision of the order and hence the revision powers have not been vested with state commissions.

Yes the State Commission can setaside the orders of the Dist Forum and can remand the matter for fresh hearing after giving opportunity to Opp Party, provided if the Appellant/Opp Party satisfies the State Commission for their absence before the forum.

For relief thru guidelines/provisions of law/directions write to NCDRC, Misnistry of Consumer affairs, Minsistry of law and/or approach Apex Court.

Involve consumer help groups, NGO’s.

Thank you for your response. When enquired under RTI Supreme Court had directed ncdrc for information. The PIO ncdrd declined stating opinions cannot be given. While a scdrc had already declined to set aside an exparte district forum order is it not unfair on the part of the same scdrc to set aside now an exparte final order of district forum?
