How much jail sentance under 498a & dpa 3/4?

Please clarify for how much time a Judge can order jail sentence if one found guilty under 498a & DPA 3/4? if

  1. accused is an old 55 years patient lady (mother in law).
  2. accused is husband.

please give general duration judges are giving, not as given in law book.

its depend on the judge, it may be 1 year, 2 year or may be three years too.

how can we say that how much sentence will be passed by Judge

Dear Qureshi sir,

if judge passes an order of 3 years than how much time accused will stay in jail?

  1. complete 3 years.
  2. total 1.5 years. (owing to day and night count)
  3. less than as in point 2. (owing to day and night count + some govt. holidays)

3 years means total day and night not that they will keep you in jail for day and will send you to home at night this is not a residential or a college were you can spend some time in jail and go to home remaining time 

you have filed a petition in the court to bar your mother from the 498a complaint and court will take all evidences were you have to prove your chances that the charges kept against you are false to come out clean
