There are many remedies available within ambit of indian law to get the things back. Onus is on you to prove that things are lying with them.

 

The more case you file the more husband gets angry and then the game starts of harassing each other in all possible ways. (Socially, legally, financially and many other ways) ..

 

Many wives may have tried instituting the cases and might have successfully delayed MCD for couple of years and enjoyed ferrying around courts for couple of years.

 

Dont get into  these traps, part ways peacefully. That would give you upper hand socially as well.

22-25 ? Got enough time to play all required games, like filing false cases etc. but then your career as a prospective bride would finish as you will be blacklisted in the matrimony market.


30-35? Take whatever they are giving. dont think too much, Find someone else who is compatible, marry off immediately. and make sure this time around dont bring upon yourself such a situation where you will find yourself roam court halls one more time.

 

Remember time and tide wait for none.

next year onward he wont be able to use those clothes, ask him to give them to helpage india.  Precious time is lost and you are calculating about 40k.???  You cannot claim those things.  even if you do claim those clothes, it'd look funny.  Gimme whatever I've given to you, clothes, chaddis, hankys etc.. would sound very funny.  Dont claim them.

Apply for MCD, let him not come to court, you get exparte orders of divorce, get divorce decree, by the end of 3rd month and 1 day get married to some one else.

Thanks so much for your reply. I told that he would not come to court session if i challenge to fight over the case because he skipped mediation sessions itself. His lawyer is also hell bent on not getting the clients to the court. He was unhappy with the turn of events after he himself in soup after filing diovorce. i dont need the clothes rather i am accounting for the money that I spent since he counts every penny including the medical reimbursement that his office gave to the employee's spouse.

the woman has all the right to the streedhan that was given to her as gift in the mariage and also the gifts given to her after the marriage are regarded as her property.

You should look for a good lawyer for consultation and then go forward.

Gifts given to her after the mariage by the girls parents are hers. But the gifts given by guys parents are not hers. She cannot claim those as hers as the bills are not in her name.

Tajaswani,

Hardly matters to whom jewellery belongs  now as:

  1. you don't have bills
  2. they have decided not to give you back

 

You will waste your time running around courts still if you want to try.

IPC 406 has almost NIL conviction as its difficult to prove that jewellery existed, handed over to him and he is not giving back.
