Leave procedure

As per the Shops & Establishment Act, Delhi every employee gets

6 Casual Leave & 6 Sick Leave and 15 Annual Leaves every year.

Last year 2011, I have used all of my 6 Casual & 6 Sick leaves due to sickness of my father-mother and as well as myself.

After this whenever I taken leave my company put me on LOP (loss of pay) which means they shown me as absentee on those days and every month they have deducted my salary as well as my attendance allowance in spite of I had all of my annual leave with me. They did not given me permission to use my Annual leave as Casual or Sick leave.

So, I want to know is my company doing right to putting me as an ABSENTEE in spite of having Annual Leaves. Can employee can not use his Annual Leaves if he exhausted all of my Casual & Sick Leave. Is there any procedure about this.

If they doing wrong what is the action I can take against my company and how.

Plz help me.

you must check with the company leave rules w.r.t annual leave.If you can tell the  various prvisions of the annual leave rules as certified by company standing order then   i can give  you the correct answer .

Even if there is leave to the credit yet the company can refuse to grant leave and treat you as absentee.

 

Leve isnot a right even for Govt employee.
