Legal opinion Required

Hi,

I have a issue with my ex-employees. As part of my letter of employment they are supposed to pay me some bonus amount after completion of 1 year.

I joined company last year 14 Feb 2008 and resigned on July 2 2009.

So my 1 year got completed on 14 Feb 2009.  then our company got screwed and we all got revised letters valid from Apr 1 which had no bonus component.

I resigned on July 2. They have decided to come up with a policy in which anyone who has left the company will not be paid due bonus. To the remaining people they will pay out in 12 installments. 

I want to seek legal opinion on this if I can sue them in court and getmy due money. Because as per what they had given in my letter, I am due for that money and if they decide to change the policy later then it is incorrect.

Can soeone help me out .

Dear Ankit,

 

yes you can sue them before appropriate court. please tell which type of company you are working there i.e. public, private or government. as far as rule of bonus is concern it is apparant to say you that if the employee is on the rolls of company on 31st march of the said calender year he is entitled for payment of bonus/adhco bonus.

It is a Private company and Bonus component is as part of my CTC. I have Basic salary way more than 6500/- per month. So I am confused as the Bonus act is not applicable.

Kindly advise.
