Marriage not consumated

Hello Members,

One of my relatives (Male) got married with a girl selected from a matrimonial site. The marriage was solemnized as per Hindu tradition prevailing in the society. On completion of almost one year, the boy fearfully disclosed his grievances to his parents that the marriage could not be consummated as his wife did not entered into physical relation with him till that time. Whenever he tried to be cozy with her he was threatened by the girl that she would complain to police for harassment and she may file a rape case against the boy in case anything is done forcefully. As the matter was brought to the notice of both sides’ parents, a Psychological counseling of girl was carried out where everything was found normal and the girl was suggested to take interest in her husband and cooperate with him to make a happy family together. When girl’s father came to know the weakness and behavior of his daughter, he told boy’s father to go for whatever formality he (boy’s father) want for getting the couple separated and marriage nullified. But the girl is adamant and she does not want divorce.  She is always demanding and has been enjoying everything since her marriage at the cost of boy (going cinema, buying clothes, jewelry  and other materials of her choice, using debit card of boys). The boy also allowed her to go her style with a hope that any day she would be agree for making a family and accept physical relation. He tried his best to keep the girl happy. Her  every activity is as a normal girl/ bride but on sleeping bed  she becomes aggressive whenever she is approached for physical coziness/ relation. Now she has convinced her father in her favor and father is also threatening the boy’s parents that if they go for any divorce suit, they (girl’s father) would file a case for harassment/ dowry  (Sec. 498).

Please advise, how to take leave from the girl ?

The case is of Kolkata and in case a good lawyer is suggested it would be a favour to us.

my friend adviced not to approach lawyer at same time the he adviced  for divorce  in which again lawyer help is needed. you should staightway  file petition in family court for annualment of marriage. donot afraid of dowery case as now a days  those are also registered after counciling. you can file a case against them under Sec 12 for annulment. As Mr. Avadesh suggeted he is correct don't be afraid of 498 A as the FIR can't be registered these days without counseliing session and only if their as certain substance in her complain then only FIR would be registered after examining those in coumselling sessions. In the mean time start collecting evidences to strengthen ur case.

PS: I m not an expert but an victim. Experts may give more technical advice.
