Hi, I am also facing the same problem. However, the difference is I am not a permanenet employee. I am on contract basis hired by the company. My contract was over, but company didnot take me into roles nor was it paying me my salary. So I had to resign. No clauses are mentioned in my contract for notice period. I want a relieving letter. Am I eligible for that ?

What is the procedure to approach the labour court, i need to get my rellieving letter frommy present employer.
Without relieving letter my new employer is not agreeing to process my joining.

Hi,
I think you should conslut with a lawer to send company a legal notice.
ask ur new employer that is there any alternative of releiving letter,tell them that u r ready to submit a affidavit mention that u r not working anywhere else.

No yar, he's not all initiating any thing regarding my exit process.
And people are teeling if we go legally also getting relileving letter and exp letter is difficult.
Dono what to do now.

I suggest u leave the company after completing notice period and send him a legal notice.How can u work with person who is stopping u only because of his self intrest.Whether that person is HR or Manager.
If its manager complain to HR.
No body can force you to work.stop working in company.Send mail to higher management reg ur issue.
and for HR of new company ask what can be done in this case.
No doubt u will be out of this trap.

All said and done, you have to choose....................what do you want, and what do you want to do?
Your employer has already acted.
If you could not make your reasoning, persuasion, negotiation skills work, despite your best efforts and if your resources could not influence this employer, than let others apply it e.g. o/o Labor commissioner/wages inspector, lawyer/law firm, courts of law.
You have the satisfaction that you tried to settle the matter amicably.

Dont mond but please suggest him some practical solution I think he has tried his best to negotiate with employee.

for one more my colleague he did the same thing, but luckily his new employer accepted his reporting without our company relieving letter.
but it is not same in my case, i need to submit atleast after few day of reporting, it is must for me.

Hi yash,
he is the whole and sole decision maker of the company, he's the owner and director of this firm.
here there is no HR manager, HR policy, leave policy, no pay slips etc etc.....,
They are not replying to my resignation mail as well a reminder mails in written.... everything they r doing in oral.....thats y i worried, if i complain i should be in a position to prove that they have recieved the mail and read it.....So how to deal with now i am worried.
