Need advice - divorce

i have done register marriage 6 months ago and i used to stay with my parents after that recently i decided to break my relation with my husband and told him to give me divorce without informing our parents but he came to my residence and informed my parents abt our marriage and now everything is out. i dnt want to continue and want divorce from him but he is not ready. how can i get rid of him...i have one sms sent by his cell to me his bank account details which he told me deposit money as we used to wrk together so he sent for that purpose but can i show that sms as dowry money demand... ? also he had cut his vain of his hand 2 weeks ago for which he got 6 sticthes can i use that as sucide threat to me as mental cruelty ? can i get divorce on these grounds ?

You can show, but it wont stand a chance in court of law.

No you cannot get divorce on these grounds.

No you cannot get divorce on these grounds.

i am nt feeling comfort with him nwdays we often fight so want to break relation i mean already done nw just marriage certificate is there

bcz i belive in love marriage so i decided to merry him but right nw i feel it was decesion in hurry...

den what what can i do get rid of him...

he did try to sucide attemp i can show its still in his hand as way of marks.

The following are the grounds for divorce in India mentioned under the Hindu Marriage Act, 1955.

Adultery – The act of indulging in any kind of s*xual relationship including intercourse outside marriage is termed as adultery. Adultery is counted as a criminal offence and substantial proofs are required to establish it. An amendment to the law in 1976 states that one single act of adultery is enough for the petitioner to get a divorce.

Cruelty – A spouse can file a divorce case when he/she is subjected to any kind of mental and physical injury that causes danger to life, limb and health. The intangible acts of cruelty through mental torture are not judged upon one single act but series of incidents. Certain instances like the food being denied, continuous ill treatment and abuses to acquire dowry, perverse s*xual act and such are included under cruelty.

Desertion – If one of the spouses voluntarily abandons his/her partner for at least a period of two years, the abandoned spouse can file a divorce case on the ground of desertion.

Conversion – Incase either of the two converts himself/herself into another religion, the other spouse may file a divorce case based on this ground.

Mental Disorder – Mental disorder can become a ground for filing a divorce if the spouse of the petitioner suffers from incurable mental disorder and insanity and therefore cannot be expected from the couple to stay together.

Leprosy – In case of a ‘virulent and incurable’ form of leprosy, a petition can be filed by the other spouse based on this ground.

Venereal Disease – If one of the spouses is suffering from a serious disease that is easily communicable, a divorce can be filed by the other spouse. The s*xually transmitted diseases like AIDS are accounted to be venereal diseases.

Renunciation – A spouse is entitled to file for a divorce if the other renounces all worldly affairs by embracing a religious order.

Not Heard Alive – If a person is not seen or heard alive by those who are expected to be ‘naturally heard’ of the person for a continuous period of seven years, the person is presumed to be dead. The other spouse should need to file a divorce if he/she is interested in remarriage.

No Resumption of Co-habitation – It becomes a ground for divorce if the couple fails to resume their co-habitation after the court has passed a decree of separation.

The following are the grounds for divorce in India on which a petition can be filed only by the wife.

  • If the husband has indulged in rape, bestiality and sodomy.
  • If the marriage is solemnized before the Hindu Marriage Act and the husband has again married another woman in spite of the first wife being alive, the first wife can seek for a divorce.
  • A girl is entitled to file for a divorce if she was married before the age of fifteen and renounces the marriage before she attains eighteen years of age.
  • If there is no co-habitation for one year and the husband neglects the judgment of maintenance awarded to the wife by the court, the wife can contest for a divorce.

Based on the Dissolution of Muslim Marriage act, 1939, a Muslim woman can seek divorce on the following grounds for divorce in India.

  • The husband’s whereabouts are unknown for a period of four years.
  • The husband has failed to provide maintenance to the wife for at least two years.
  • The husband has been under imprisonment for seven or more years.
  • The husband is unable to meet the marital obligations.
  • If the girl is married before fifteen and decides to end the relationship before she turns eighteen.
  • The husband indulges in acts of cruelty.

Let us check out the following grounds of divorce mentioned under the Indian Divorce Act, 1869.

  • Adultery
  • Conversion to another religion
  • One of the couples suffering from an unsound mind, leprosy or communicable venereal disease for at least two years before the filing of the divorce.
  • Not been seen or heard alive for the period of seven or more years.
  • Failure in observing the restitution of conjugal rights for at least two years.
  • Inflicting cruelty and giving rise to mental anxiety that can be injurious to health and life.
  • Wife can file a divorce based on the grounds of rape, sodomy and bestiality.

The following are the grounds for divorce in India included in the Parsi Marriage and Divorce Act, 1936 and the amendment of the same in 1988.

  • Continuous absence of seven years.
  • Non-consummation of marriage within one year.
  • Unsound mind provided the other spouse was unaware of the fact at the time of marriage and the divorce must be filed within three years of marriage.
  • Pregnancy by some other man provided the husband was unaware of the incident during the time of marriage and that he must not have undergone s*xual intercourse after he came to know about the situation. The divorce must be filed within two years of marriage.
  • Adultery, bigamy, fornication, rape, or any other type of perverse s*xual act.
  • Act of cruelty
  • Suffering from venereal disease or forcing the wife into prostitution.
  • Sentenced to prison for seven years or more
  • Desertion for two or more years
  • Non-resumption of cohabitation after passing an order of maintenance or a decree of judicial separation.

i have read all n know all grounds of divorce...but nthing is right nw in my favour...i need to get rid of him asap and want to move on in life want to marry where my parents are ready in my cast...i dnt want delay anything...as of now i can show dowry demand for which i have his sms of bank details and his cut on hand which can be useful to show mental cruelty of threatening me...i dont have more points as of now...

Looks like your husband is heartbroken.


You need to sort it out.  Getting divorce is not easy.  Even if you go for mutual consent divorce, if your husband does not agree to give you divorce, then contested divorce case will take easily 5-6 years, if you listen to lawyers and having a criminal intent of further hurting your husband, then you can file false cases like PWDVA, 498a etc, but if your husband is still adamant and fights out all the cases you would have filed against him, then that will add up to a cool 6-7 years, in all of this you cannot get remarried, if you do so, you husband can file a complaint against you for adultery, and when he comes out clean out of false cases, he can file a case of prejury against you and you will sit inside jail for a good 7 years.


MCD = 6 months


Contested divorce = 5-6 years


Constested divorce + false cases = 12-14 years, by the end of it you may still not get divorce!

He had visited my relatives residence once den i called police and he was given warning for same...can i use that for harassing me n my relatives...also i had called his brother on his cell but his brother was rude n abused me sm bad language can i use this things overall to get divorce...

Since you don't have solid ground for divorce, you can not get divorce easily. it will take around 5-6 years if you contest the divorce case. 

Better option to convince your husband for MCD( it will take 6 months only)

Hai,

Read your story in detail and the advice given by helping hand is quite appropriate.

And I do agree with him.

My suggestion:

 you have entered into the bond of marriage with him without thinking any further complications i.e., adjustment, habits understanding etc., with him.  Marriage is not a game of toys.  It is a bond between two persons which involved rights and privileges of both sides i.e., you and he. For escaping from the bond there are statutory rules and regulations which you must follow  at any cost. The more you haste the more you have to face struggles.  Moreover you seem very haste in taking decisions i.e., entering into marriage and coming out of marriage.  For every action you have to think twice and act accordingly but in your case thinking about your life is absolutely  absent.  At the same  time can you adjust with the new one you are going to marry in future (if we presume that you got divorce in future).  Your reasons for leaving him  are not  justifiable and  you cannot defend him before the court of law.  Hence wait for some time  for fulfilling of statutory period of time for getting mutual divorce.  In the mean time try to convince him  for mutual divorce.  Mutual divorce is the only option for you to fulfill your wish. There is no other option which must be   accepted by him for which you must try and try. Hence be patient and wait for your good days. Good luck

he is not ready for mutual divorce...he wants me back..he sent me notice to come back and i replied that i want divorce...i am planning to file for divorce on false promises made by him to me and also on asking money from my relatives n me...also on harresing me my family and relatives. i need divorce at any how.
