Need experts suggestion

I filed a divorce petition u/s 13 (1) (a) on cruelty grounds 0n 14.03.2012.  Subsequently she filed 498A  and DVC and 125 crpc as counter blast.  I was acquitted in 498A case.  Now it is almost 3+ years of pendency, now 13 (1) (b) desertion ground attracts? since the pendency is more than 3 + years and she did not made any effortsfor rejoining and filed false cases against me.

I need eperts suggestions & guidence and relavent apex court judgments as I am attending party in person.

Dear - acquital from 498a itself is a sound ground for cruelty

Yes. you can add it.  But for that, you have to move an application for amendment of original petition.  If court allows such application, then you can file amended divorce petition on the ground of cruelty as well as desertion.  If your case hasn't reached the stage of issues, then you can do so.
