Non occupancy charge in housing society under maharashtra

Hi We have a flat at vasai maharashtra it is on my father's name who got expired and we were living overthere but recently we moved to our new house. As we are legal heirs I have made a request along with all documents and paper notice to society to change this property in our mother's name and and society says it is under process and soon it will be done. After shifting to new house my married sister alongwith his husband is living at above mentioned property from one month. Recently my society gave a maintenance with non occupancy charges of rs 200 for 2 months. Also they imposed parking charge for 2 months but they are living from 06th June only. Also we have not given it on rent to my sister and we have not made any leave & license agreement. Our maintenance is around 700 rs per month. So please help me with rule or act no. Whether charging above mentioned non occupancy charge is legal or not. Also tell me the % amount that can be charged on maintenance amount.
