Non performance of contract(verbal)

Dear All, Below mentioned are the facts of my case. I had an verbal understanding with an friend regarding setting up an website. He told me he will setup an website for me with overall cost amounting to R's 8000 including his fees. I already paid an advance amount of Rs. 2000 as instructed by him. But now he is not even picking up my call, I've been trying to reach him since last 1 month but he is not responding. Hence, I'm contemplating to take legal action against him. Please advise me whether I hold any legal ground to file a suit. I have not entered any written contract with him but I do have the bank statement showing the transferred amt to his account. Please give me ur valuable advice.
