NRI Divorce -Irretrivable Break down of marriage

Hello

I am an NRI currently residing in Gulf Country . I am married past 3 years we got 2 years old baby. My wife left the place with few quarrels with me . I delibertely given her 45 days visa to return back but she havent turn back . Now its near to 3 months. She is completly hearing her home side dosent give respect to my words . I am not willing to blame her for anything . I am looking for divorce .Intially she accepted for mutual concent divorce now with her parents guidlines she is not accepting it . What should i do now . we have no contact each other . She is mentally sick (i got few proof for it ) .

Quesstion :

1) Irretrivable break down of marriage act can i use this act to apply for dicorve . Is it currently live . since There is no emotion in our life and i felt the marriage is dead .

2) Being an NRI what i should keep in mind to get quicker divorce?

3) Can they file case against me and my family ? even she havent stayed in matrimony home for more 2 months.

4) what should i do to cover myself ? Should i first send legal notice or directly apply in court with irretivable break down of marriage

5) do i need to visit court often ? Being NRI is there any special  consideration ?

6) can i first Divorce notice from india just to keep the process running till i step in through my advacate ?

Your answer really help me . I am coming to india shortly . Upon your advice i will act

You mentioned that you have proof that your wife is mentally sick. Hope it's admissible as evidence in court. When it comes to hiring a lawyer, my personal experience is to get things down in writing (ask about whether you will get signed updates, so that your counsel cannot misguide you about what they're doing). Find someone who answers email promptly, so that everything will be documented and you won't have to waste money with long-distance calls. don't give fat upfront retainers know what services your fees covers.

Irretrievable Break down theory is still not a ground for divorce in the written law.

 

Hon'ble SC applied it in certain cases but now has specifically said that neither the HC nor the Trial court can grant dirvoce on this basis alone.

 

you ll have to contest the case and prove the things as per your allegations.

 

No special provisions for NRIs as far as divorce is concerned rather the presumption is against NRIs.

 

come prepared the other party may also take legal steps against you.

On the ground of your wife's condition you can seek a divorce.   You will have to be present before the court to file the case and for conciliation also you have to be present.  6 months to wait , it is mandatory, but in special cases court wont wait for 6 months and it can take the matter imeditely.

Kiran -Bit confused here should i directly file divorce on the ground of Irretrivable Break down of marriage . Do i need send any legal notice before filing or can i file it directly in the court  so that court can send out summen . 

I am coming to india July or august how long it wiill take to file the case & send her notice about the filing .

If the above is not possible i got some certification from physctrict that she is mentally mild disorder & few proff when she admit she got mental probelm b4 marriage even. 

which direction i should take honestly i am willing to point her any wrong thing in front of law . I wish the divorce should be blameless & decent seperation.

Hi,
 
My name is amit lives in jaipur.  I have been in relationship with a girl of jaipur.
Last year We have done marriage 13-03.2010 in Arya Samaj and I also Registered it in Nagar Nigam Jaipur.
 
As girls family was not in favor of marriage, so we decided to run from home on 30-Apr-2010, We were together till 10-May-2011.
 
When We called her father he said us that please come back We will arrange everything normally and make a reception of marriage.
 
We both decide to come back, I dropped the girl at her home and we decide to wait for some time.
 
The girl was in my contact regularly, but before two month when I approached to her and her parents they both clearly said no, and girl also refused to come with me.
 
Now there is no contact between me and the girl since last one month, her father and she also stopped communicating me in any way.
 
Whenever I tried to ontact any of her relatives they also refuses to talk with us.
 
But I am sure, If the girl will live with me only for some days everything will be normal.
 
Could any one please guide me, how can I meet her is there any way in law which allows me to meet her.
 
Also want to know, what are the cases they can file against me, if I go to her home directly to talk to her.
 
I am sure her parents are doing this all to save their reputation in Society.
 
What are the other ways by which I can bring her at my home.
 
My parents already approached her and she clearly said no to them.
