Parental Property Claim

My grand father(as a guardian) purchased one residential property under name of my father and one of his 3 brothers when both of them were under 18 years old.Due to family dispute elder son(none from the joint holders) was allow to live in that property since he was married first.

Now we(joint holders) are trying to claim that property but that elder son wants full property in his name and won't empty it.

Please help with your advice.

Dear Prateek 

It's simple in cases like these if your father has purchased the land by his money his brother has no right to demand a division in eldest brother property. If his brother will file the title or partition suit than he would have to prove that the land was purchased by father, then he can also claim that land.
