Probate

Hi, I want to know if probate is necessary for wills in Scheduled areas. If no, under what Act ?

Please refer to sections 213 and 57 of the Indian Succession Act. In my opinion, will need not be probated in all Scheduled Areas per se.

If the Will is disputed then it would be necessary to seek grant of probate of will through a court competent.

Actually it is mandatory to probate will in three presidency towns namely Bombay, Calcutta and Madras.

In other places it depends on the circumstances.
