Procedure to file appeal in highcourt ap

divorce petition dismissed. RCR upheld. wish to file appeal in high court.

 

1) Do I need to be present "personally "while filing appeal?  i stay in chennai.

2)  will there be mediation again?

 3)  do i need to come for mediation?

4)  chances for speedy trail petition to suceed?

5) matter needed for appeal to be allowed?

NO

YES, unless refused by either u / opponant.

 

3)  do i need to come for mediation?

NOT MANDATORY.

 

4)  chances for speedy trail petition to suceed?

divorce & RCR both are disposed off. now which trial do u want to speed up ??

 

5) matter needed for appeal to be allowed?

why was divorce petition dismissed, on what grounds???

i filed divorce.  

my divorce petition dismissed, on ground  that no single allegation of cruelty is proved . instead the judge wrote that  i treated her with  cruelty .

judge also mentoned divorce was filed within 1 year ,and no petition under sec 14 was moved for wavier of one year period and ignoring this the petition was numbered and it is not maintainable.but he didnt mention it as a ground to dismiss petition. is it a hurdle to appeal?

her RCR upheld and directed to join me within 1 month. 

appeal period is 90 days . so if she come to me within one month,what should be done?

she does not  know my house, but she knows the office address. what if she creates a scene there?

can she go to my parents place?

1. why you running away from your legal wife????
2. why filed for divorce?
3.judge rightly dismissed as female favored by law....and dismissal is also explained..
4. now follow rcr , yes she can go 2 your parents, file DV, ask for injunction orders etc etc.....but why you neglecting her? that way you entitled for maintenance...

5. try settling amicably or file MCD if no strong ground.....

6. ground for divorce need to be strong , do not file for sake of filling, you would be wasting money, time and youth.
