Property rights

Hi All,


My father and Uncle own a property in Bangalore which we  have lived in since brith. My uncle's wife left him in 1985 and moved away although they had a son. The son has been living with his mother and also she got married to someone else in the mean time. Now i want to know if the son is a legal hier to my property. He has not lived with us and his mother is married to someoen else. He has been harrasing us to sell the property.

 

Please advice us .

Yes, He can claim his share in the property. As per hindu suceecsion act, 1956 he is entitled for the share in the property.

As per rule 2 of Sec 10 of the Hindu Sucession Act 1956, he is eligible for caim.

Yes your cousin is legally entitled to claim his share in questioned property as he is legitimate son and legal heir of your uncle.It is hardly matter that his mother has got  married to some other person and  he is living with her.
