Sir - Sale Agreement executed Dec.15,2005 with builder with date of first installment to be paid on October 9th and 2nd installment to be paid on Dec 1st - The above two and subsequent installments never paid on some pretext or the other - Builder issued cancellation Notice - Buyer sought more time and made a small payment in September 2006 and got issued a letter asking him to inspect the under construction apartments to assess the progress and suggest changes to the apartment he booked.- Builder got vexed with the buyer and sold flat to another  buyer in October 2006 without informing of the earlier cancelled agreement and executed sale deed in Jan 2007 and handed over possession.In Feb 2007 the first party issued legal notice to Builder asking for registration and went to court and 2009 got the subsequent buyer impleaded in the case and later in an amended petition claims collusion between between Subsequent Buyer and Builder and seeking cancellation of sale deed.-claiming he has subsisting agreement with builder.
