In how many days can I get stay on ancestors proerty...for how long stay order is valid..

Injunctions are of two kinds- Temporary,Status quo, permanent.

Three pre-requisties to be satisfied by petitioner to grant the any of above referred injunction/s:

   1. Prima facie case, 2. Irreperable loss/injury and 3. Balance of convenience.

   Duration of injunction order differs from case to case.

  Eg.Status quo order is given for only a 10 or 15 days until next date of court.

       Temporary injuction/ permanent injunction may be granted tor a short duration/ until disposal of the case as the case may be.

Dear querist,

Stay order can be granted on the day of filing itself if there is sufficient reason. However if there is no urgency, court can pass order on next dates. It is upto you how you proceed with the matter.

If it is ancestral property court doesn't grants stay because Evey one has birth right over ancestral property how can court grant stay it can grant stay to not to alienate the property until suit is disposed.after partition is decided if you take possession of property of your share then afterwards if they interfere to your share then it will grant.
