Using of wheel clamps to stop illegal parking in hsg society

Dear Sir

 

We are a society of 120 members and we are having issues with illegal parking in the society (i.e. cars without society stickers are being parked), In the AGM, we have passed a resolution that Rs 1000 will be fined for such illegality but we have seen that sometimes by the time the fine is being imposed the said vehicle has vanished leaving with us no proof to impose the fine. So the Managing Committee has proposed that wheel clamps be fitted in the said illegal parked cars and the same will be removed only after payment of fine. I wish to know is this wheel clamps suggestion legally tenable?

If the premised belong to the Society and you place a board warning that wheels will be clamped in the event of unauthorized parking, I see no reason why it should be illegal. But I am not sure about the Rs.1000/- fine.
