Complainant filed a complaint under the provisions of Negotiable Instruments stating that the accused borrowed a certain sum of money and thereafter the cheque given for the satisfaction of the loan was dishonored. The accused wants to take the plea that on the alleged date of loan the financial status of the complainant was not such o provide the alleged amount of loan.
