If on same cause of action (1) police files a criminal case under 498a on the complint of wife after regitering FIR and investigation, and (2) husband files a divorce case; Then which case can be given prority by court?

both cases taken as per numberwise, so who ever reach the court first, it will come first

Cases would be numbered as first come first basis ............................. rest depends on merits, contents and context of the case and also also how the cases make progress or how they are scheduled to make progress!! ...................... and cases are disposed in due course of time !!
