Hi all,
Can wife declare NRI husband's foreign income in section 24 HMA petition in Indian Court without the written consent of the husband as required by the laws of the foreign country?
You may note that Data protection act of many developed foreign countries prohibit the use of personal data including monthly wages information without the explicit consent of the person in question.

She is not disclosing it in public; she is taking averment in a petition seeking maintenance. She can very well do that.

In order to substantiate her justified claim for maintenance amount sought to be granted by court, she is very well within the law to make a mention about her husband's income, there is nothing illegal about it, it is universally recognised,dont know which country's law is being misinterpreted by the querist here.
