Divorce

I got married in June 2001 my wife has bad attitude and irretrievable character hence I had suffered from some mental illness and treated for last 7 years hence no good s*x with her by me and no issue. Now I am able to do good s*x but unfortunately, my sperm count is low hence, we have to take medical treatment such as test tube baby but she is not ready for the same as she feels it will give side effect.

She does not understand me at all hence it disturb my day to day mental health hence I moved to family court in the month of January 2010 for divorce on grounds that cruelty but she is not ready for divorce and purposefully she makes delay like not attending the court proceedings and occasionally she is attending the court

I kindly request you to clarify me following clarifications

Government amended the Hindu marriage act two months ago i.e. irretrievable character, which was not applicable at the time of my filing in the court hence whether I can add this clause now.
As I explained above, I am interested for baby where as she is not interested hence whether I will get divorce on this ground also.

For such (read emotional adjustment) issues there was no need to file a case is my opening comment.

The IrBM (Amendment) Act, 2010 you are referring to is not applicable to your case and moreover it is not yet Law currently it is in Parliament.

See, a spouse as per jamal khota customs and traditions of India is bottlefed from birth to have his/her own bloodline from a sequence of "natures way of reproduction by a couple" and society raises eyebrow when IVF / Surrogacy or even Adoption options are tried for a bloodline by a couple.

Take and or both of you seek marital counceling for number of sessons so that the last minute hitch in your wife is removed and you also learn the small talk way out of such situations and for that there is no need for divorce. Think the long term package you will be saving on the name of compromise just that your wife didnot agree for IVF whereas within a couple these issues could have been settled.
