ABC COMPANY LTD IS A SUBSIDIARY OF XYZ CO LTD. ABC CO LTD HAD APPOINTED SOME EMPLOYEES IN THEIR ORGANISATION WITH MUTUAL CONSENT OF EMPLOYER AND EMPLOYEE. NOW ABC CO LTD DECIDING TO MOVE/TRANSFER THEIR EMPLOYEE FROM ABC CO LTD TO XYZ CO LTD WITHOUT TAKING ANY WRITTEN CONSENT FROM EMPLOYEE.

 

ABC CO LTD IN THEIR APPOINTMENT TERMS TRANSFER POLICY MENTIONED AS “THE COMPANY MAY TRANSFER ANY OF ITS EMPLOYEE TO ANY OF ITS CENTRES AND OFFICES IN ACCORDANCE WITH ITS REQUIREMENT AND DEVELOPMENTAL PLANS FOR THE EMPLOYEE”

 

PLEASE ADVICE

  1. WHETHER SUBSIDIARY ABC CO LTD CAN MOVE OR TRANSFER THEIR EMPLOYEE TO XYZ COMPANY WITHOUT TAKING ANY CONSENT FROM EMPLOYEE
  2. CAN ABC CO LTD FORCE ANY EMPLOYEE TO MOVE TO XYZ COMPANY WITHOUT ANY CONSENT TAKEN FROM EMPLOYEE
  3. IF SERVICE RECORD OF CONCERN EMPLOYEE IS VERY GOOD CAN THEY TRANSFER THEM CONSIDERING THE ABOVE MENTIONED TERMS TO XYX COMPANY WITHOUT PROVIDNG ANY REASON OR JUSTIFICATION
  4. IF THE EMPLOYEE HAVING ANY LEGAL REMEDY PLEASE ADVICE
