Gift Deed Query

Hi,

My question is in regard to a gift deed based on an MOU which was part of an out of court settlement.

As per the MOU the donor was to gift the flat via a gift deed to the donee and also perform some other tasks. More than a year after the Gift Deed was registered the donor has not completed the tasks and now wishes to withdraw the MOU.

Can an MOU which has been registered in a court be withdrawn? What happens to the Gift Deed? Can it be revoked because the MOU is being withdrawn?

If the MOU been duly recorded in court then it cannot be withdrawn unless it shown before the court that fraud has been done in execution of MOU.  Otherwise the MOU will stand valid.

 

Moreoever if the gift deed which had been executed/registered in pursuance of the MOU is irrevocable in terms of its clause then there can be no revocation of gift deed.
